Terms of Use
These Terms of Use (“Terms”) constitute an agreement between you and OffGridHousePlans.com governing your use of this website and any products or services, including house plan sets (“Plans”) available through this website from time to time.
The website and associated products and services are collectively referred to as the “Site” in these Terms.
By using the Site, for viewing or ordering Plans or otherwise, you acknowledge that you have read, understood, and agree to be bound by and comply with these Terms.
Eligibility: The Site is intended for adults. You must be at least 18 years old to order or use any Plans or access the Site.
Prohibited Actions: When using the Site, you agree not to:

Your Builder’s Responsibilities:
You acknowledge and agree that, the following items are your builder’s and your responsibilities:
• Compliance with Laws and Standards: Your builder is responsible for ensuring that all work complies with the latest editions of applicable national, state, and local building codes, construction industry standards, and other relevant laws.
• Permits and Inspections: Your builder must obtain all necessary permits and inspections from local governmental agencies.
• Plan Verification: Before construction, your builder must check the Plans to verify all dimensions and details are accurate and suitable for local conditions.
• Material Selection: Your builder is responsible for collaborating with you on the final selection of materials (e.g., masonry, joists, lumber, roofing) that may affect dimensions and construction details.
• Construction Practices: Your builder must provide standard construction details and practices to ensure a structurally sound and weatherproof finished product.
• Construction Management: Your builder is responsible for all construction means, methods, sequencing, techniques, and safety for workers and third parties on the job site.
• Quality of Materials: Your builder must ensure all materials, equipment, and components are new, of good quality, and installed according to manufacturers’ instructions to preserve warranties and guarantees.
OffGridHouseplans and its Designers shall have no responsibility or liability concerning these responsibilities.
General Terms:
Who Owns What:
OffGridHousePlans, its Designers, and other licensors retain all Intellectual Property Rights related to the Site. This includes all Plans, customized versions thereof, and all graphics, photos, videos, images, artwork, text, software, and other technology on the Site, as well as its contents, design, layout, functions, and appearance. The Plans are protected under United States Copyright Laws. Unauthorized use of any information beyond the one-time use authorized by the License, or any reproduction, publication, sale, or distribution of any part of the Plans without OffGridHousePlans’ prior written consent, constitutes a violation of Federal Laws and could result in prosecution and penalties.
You confirm that you own all Intellectual Property Rights in any information you submit (“Your Information”). By submitting Your Information, you grant OffGridHousePlans a non-exclusive, royalty-free, worldwide, perpetual, irrevocable right and license to use it in connection with the Site and in accordance with our privacy policy.
For these Terms, “Intellectual Property Rights” include all rights related to trademarks, service marks, trade dress, logos, copyrights, rights of authorship, and all applications, registrations, derivative works, renewals, database rights, moral rights, inventions, rights of publicity and privacy, trade secrets, know-how, and rights under unfair competition and trade practices laws, along with all other related intellectual and industrial property rights worldwide.
Indemnity
You agree to indemnify, defend, and hold harmless OffGridHousePlans, its affiliates, their Designers or licensors, and all of their officers, directors, owners, agents, employees, contractors, and assigns (collectively, the “Indemnified Parties”) from any losses, demands, claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
• Your use, misuse, or modification of the Plans or any materials provided by OffGridHousePlans or its Designers;
• Any negligence or misconduct by you or your employees, consultants, agents, or contractors;
• Your breach of these Terms or any applicable Designer Agreement.
OffGridHousePlans retains the right to assume, at its own expense, exclusive defense and control of any matter you are required to indemnify. This may involve allowing a Designer to assume this defense.
DISCLAIMER
YOU ASSUME ALL RESPONSIBILITY AND RISK ASSOCIATED WITH YOUR USE OF THE SITE AND ANY PLANS. THE SITE AND PLANS ARE PROVIDED “AS IS” WITHOUT ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. YOU AGREE TO VERIFY THE ACCURACY, SUITABILITY, AND LEGAL COMPLIANCE OF THE PLANS BEFORE USE.
Additional Disclaimers and Requirements
· Design Intent and Construction Detailing: The Plans are intended to show design intent and basic construction detailing. You are responsible for obtaining professional assistance to ensure the construction results in a structurally sound and weatherproof finished product. Use or modification of the Plans by you, your builders, or others acting on your behalf is at your own risk.
· Specialized Drawings: The Plans do not include plumbing, heating, or air conditioning drawings due to varying local codes and climate conditions. It is required that local professionals such as electrical engineers, mechanical engineers, or builders be consulted to provide necessary drawings for permits and construction. You agree that you will have the Plans reviewed and approved by a professional engineer and the local governing agency before construction begins, with both the engineer’s ‘wet stamp and signature’ and the local governing agency’s.
· Foundation Plans: Foundation plans in the Plans serve as basic guides and are not tailored to specific sites. It is required that a licensed engineer reviews these plans to provide a site-specific foundation design. You agree that you will have the Plans reviewed and approved by a professional engineer and the local governing agency before construction begins, with both the engineer’s ‘wet stamp and signature’ and the local governing agency’s
· Completeness and Compliance: The Plans provide concepts and are not complete in all respects. Local building codes, zoning requirements, and other regulations may necessitate modifications. You are responsible for ensuring compliance with all local requirements and for obtaining necessary permits and inspections. You agree that you will have the Plans reviewed and approved by the local governing agency before construction begins.
· Material and Manufacturer Information: Names of materials and manufacturers shown on the Plans do not constitute endorsements. You and your builder are responsible for the final selection and installation of materials.
· Professional Review: The Plans do not carry an architectural or engineering signature, seal, or stamp. You must consult with local building officials to determine if a review by a licensed designer or engineer is required before you submit the Plans for a building permit.
· Jurisdiction-Specific Requirements: You agree to consult local building officials or legal counsel as needed to meet these requirements.
· Errors and Corrections: OffGridHouseplans may correct any errors in Plan details or pricing as discovered. Orders and associated pricing are not final until confirmed by OffGridHouseplans.
· Photographs and Modifications: Photographs on the Site may show houses built from modified Plans. Such modifications are not included in the Plans provided.
By agreeing to these terms, you affirm your commitment to have the Plans reviewed and approved by a professional engineer and the local governing agency before construction begins, and to strictly adhere to all applicable local building codes, regulations, and requirements.
Limitations of Liability
In no event shall OffGridHouseplans, its affiliates, or any designers be liable for any indirect, punitive, incidental, special, exemplary, or consequential damages arising from or related to your use of, delay in using, or inability to use the Site, including any Plans. Liability for direct damages shall be limited to the greater of the amount you have paid to OffGridHouseplans for the matter giving rise to the liability or $100. This limitation applies unless such exclusions of liability are prohibited by your state or jurisdiction. In cases where these limitations are not allowed, OffGridHouseplans’ maximum liability shall not exceed $100. This agreement is governed by the laws of the State of California, and any disputes related to these terms will be resolved exclusively in the courts of California.
Termination
We reserve the right to terminate these Terms, the License, and/or your access to the Site at our discretion without limitation, should you fail to comply with any provisions of these Terms or any Designer Agreement. The License may also terminate upon the completion or abandonment of the Project.
